The Patna High Court has negated the amendments passed by the Bihar Legislature in 2023 increasing the reservations for Backward Classes, Extremely Backward Classes, Scheduled Castes and Scheduled Tribes. As per the amendment to the Bihar government reservation rules the reservations for these categories have been increased from 50% to 65%.
A division bench consisting of Chief Justice K Vinod Chandran and Justice Harish Kumar passed the ruling on a batch petition filed challenging the enactments as violative of equal opportunities for citizens in matters of employment and education.
Patna HC has struck the Bihar government reservation policy - Bihar Reservation of Vacancies in Ports and Services (Amendment) Act 2023 and Bihar (In Admission in Educational Institutions) Reservations (Amendment )Act 2024 as ultra vires the constitution and violative of the equality clause under Articles 14, 15 and 16 of the Indian Constitution.
The legislature in 2023 amended the Bihar Reservations of Vacancies in Posts and Services (For Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act 1991 after taking note of the data which revealed that members of SC/ ST and other backward classes were still comparatively less in proportion in government services.
