The proposed changes were particularly significant for students on F-1 visas, including thousands of Indian students pursuing undergraduate, postgraduate and doctoral programmes in the US.

The US Department of Homeland Security (DHS) had proposed ending the long-standing “duration of status” (D/S)system for international students. Under the existing framework, eligible F-1 students can generally remain in the US while maintaining their student status and making normal progress towards completing their approved programme. The rule was scheduled to take effect on September 15, 2026.
Federal Court Blocks US Student Visa Stay Limit Rule
In a major development, US District Judge F. Dennis Saylor blocked the Trump administration's rule on September 14, one day before its scheduled implementation. The court found that DHS had not adequately followed the legal requirements for changing the policy and had failed to sufficiently consider less restrictive alternatives.
For Indian students, this is an important distinction because earlier reports had warned that the new system could significantly affect students whose academic programmes extend beyond four years or who require additional time to complete their degrees.
What Was the Existing 'Duration of Status' Rule?
Under the existing system, F-1 students are generally admitted for the duration of their authorised academic programme, rather than being restricted to a fixed four-year period.
This system gives students greater flexibility if they need additional time to complete their programme while remaining compliant with their student status.
For example, a student pursuing a bachelor's degree who later continues into a master's or doctoral programme could potentially remain in the US under the existing framework without being automatically restricted by a four-year admission limit.

How Would the Rule Have Affected Indian Students?
If implemented, the proposed US student visa changes could have affected Indian students in several ways:
1. Fixed Period of Stay
Students would have received a fixed period of authorised stay linked to their academic programme, subject to the proposed maximum of four years.
2. Additional Time Would Require an Extension
Students unable to complete their programme within the authorised period would have had to apply for an extension rather than simply continuing under the existing duration-of-status framework.
3. Longer Academic Programmes Could Face More Scrutiny
Students pursuing PhD programmes, extended research programmes or courses requiring additional time could have faced greater administrative requirements.
4. International Travel Could Require Greater Planning
The proposed changes also raised concerns for students travelling outside the US and subsequently returning after the new system came into force. Universities had advised international students to carefully review their travel plans.
US Student Visa Rules: What About the 30-Day Grace Period?
Under the proposed rule, the post-completion departure period for certain international students would have been reduced from 60 days to 30 days. This would have given students less time after completing their programme to depart the US or take appropriate immigration steps.
However, because the federal court has blocked the broader rule, students should not assume that these proposed changes have taken effect.
