The Delhi high court on 1 March 2012 quashed petitions filed by 12 Delhi councillors in which they had challenged the notification issued by state election commission to reserve seats for woman and scheduled caste (SC) candidates.

A high court bench of justices Sanjay Kishan Kaul and Rajiv Shakdher maintained that there is “nothing wrong” in the mode and manner of reservation. The court also upheld the Delhi government’s decision to delegate the power to reserve seats to Election Commission (EC).

The court in its verdict held that no fault can be found with the delegation of power under Section 490B of the said Act (Delhi Municipal Corporation Act) by the notification dated January 24, 2012 and the challenge to the same is misplaced.

12 councillors had filed a petition in the High Court against the election commission’s notification to reserve seats for woman and scheduled caste (SC) in the MCD poll. In the petition they had also questioned the Delhi Government’s decision to delegate the power to reserve seats to Election Commission (EC).  Delhi is set to hold municipal elections in April 2012.
