Himachal Pradesh state cabinet on 27 July 2011 amended the rules for granting permission to purchase plots under section 118 of HP Tenancy and Land Reforms Act. The cabinet did this with the objective to curb discretion in giving nod for buying land.The amendment to rule 38-A (a) (2) will make sure that the non-agriculturists living in the state could secure permission to purchase land.
The misuse of section 118 had become a volatile issue recently because it barred all non-agriculturists including bonafide Himachal Pradesh people from purchasing land in the state.
Only those Himachalis settled in the state prior to 1972 or working in the state for past 30 years could get the permission to purchase land for dwelling unit. They need to possess bonafide Himachali Certificate.
