The Supreme Court will hear a petition seeking the release of former Jammu and Kashmir Chief Minister Mehbooba Mufti today. The petition has been filed by Mehbooba Mufti's daughter Iltija Mufti.
The former J&K Chief Minister and PDP Leader's detention was extended for another three months on July 31 under Public Safety Act (PSA). Her earlier detention order had been scheduled to expire on August 5.
The PDP leader has been kept under detention at her official residence at Fairview Bungalow, which has been declared as a subsidiary jail. Mufti was shifted to her home on April 7, providing partial relief to her. Prior to that, she had spent over eight months in detention at two government facilities that were converted into sub-jails.
Mehbooba Mufti's daughter files habeas corpus writ petition
Mufti's daughter, Iltija Mufti had filed a habeas corpus writ petition before the Supreme Court in February 2020, challenging her mother's detention. Following the filing of the plea, the three-judge SC bench had issued a notice to the J&K administration seeking a response to the plea. The top court had then posted the matter for hearing on March 18, however, the petition was not taken up for discussion due to the COVID-19 outbreak.

The habeas corpus writ calls for the production of the detained individual before the court along with valid reasons for the person’s detention.
Background
Mehbooba Mufti was placed under detention along with many other leaders of Kashmir including two former J&K CM's Farooq Abdullah and his son Omar Abdullah following the abrogation of Article 370 of the Indian Constitution on August 5, 2020.The article had accorded special status to the erstwhile state of Jammu and Kashmir
While Farooq Abdullah was released from preventive detention in February 2020, Omar Abdullah was released in March. Mufti's preventive detention was, on the other hand, extended.
