Madhya Pradesh High Court terms reservation in promotions in the State as unconstitutional

The division bench said that reservation to underprivileged during appointments is logical but reservation in promotions frustrates talented people.

MP_High_Court The Madhya Pradesh High Court on 30 April 2016 termed reservation in promotions in the state as unconstitutional.

The division bench chaired by Chief Justice AM Khanwilkar stated in its order that the reservation to underprivileged during appointments is logical but reservation in promotions frustrate talented people.

It said that giving priority to reserved categories over general classes in promotions is not justice.

The verdict was passed by the court while hearing petitions filed against reservation in promotions in the court by several employee associations and social organisations. The petitioners in their plea challenged the rules of the state government which provided reservation in promotion for Scheduled Castes and Schedule Tribes.

Petitioners urged that these rules are against provisions of the constitution.
