Under the Emblems and Names (Prevention of Improper use) Act 1959 , a Supreme Court bench comprising Chief Justice K.G. Balakrishnan and Justices Deepak Verma and B.S. Chauhan rejected Montblanc's application on 3 May 2010. Through the application Montblanc had sought permission for using the engraved image of Gandhiji for sale of its Mahatma Gandhi Limited edition pens to commemorate the 140th birth anniversary of the Father of the Nation. It was alleged that the company was using the image of Gandhiji for commercial purposes.
