NEET 2021 Result: The Supreme Court of India has refused to allow re-exam for two students from Maharashtra as ordered by Bombay HC after irregularities had surfaced. Setting aise the Bombay HC order which had directed National Testing Agency (NTA) to hold re-exam for the two students, the apex court said that such an order can be detrimental for the future. Justice LN Rao who was hearing the matter today, expressed sympathy with the medical aspirants who were affected by this decision, but added "We feel sorry for the students and sympathise with them but cannot hold a re-examination."
Re-Exam May become Pattern if Allowed
Making interesting observations during today’s hearing, the apex court noted that, if the order to hold re-exam for individual cases and students was passed by the court, it would set a wrong precedent for the future. Justice Rao who was hearing the case today added that if allowed, going forward students would often make it a pattern to move court seeking re-exam even for minor matters. Justice Rao’s remarks also noted that "Every year students will come forward and seek a re-exam for one mistake or the other.” Therefore, it was important for the court not to intervene in the matter, especially considering that the results have already been declared.
Why was Re-exam ordered by Bombay HC?
Earlier in October, two NEET aspirants from Maharshtra had reached out to the Bombay High Court alleging mistake by exam invigilator in distribution of answer sheets to them. Aspirants Vaishnavi Bhopale and Abhishek Kapse noted that at their NEET exam Centre in Solapur, exam invigilators handed them mismatched test booklets and answer sheets and didn’t rectify the issue even when pointed out by both the students. After assessing given evidence in the case and hearing NTA’s stand on the matter, High Court then directed the National Testing Agency (NTA) to conduct NEET re-exam afresh for the duo with 48-hours notice.
