Supreme Court said No to PILs on Policy decisions

On 19 July 2010, the Chief Justice of India SH Kapadia ruled that Supreme Court will not entertain Public Interest Litigations (PILs) related to government policy decisions.

On 19 July 2010, the Chief Justice of India SH Kapadia ruled that Supreme Court will not entertain Public Interest Litigations (PILs) related to government policy decisions.


A three-judge bench headed by Justice SH Kapadia gave its judgement that the Supreme Court has no power to interfere in governance or policy matters. The Supreme Court will not entertain any PIL based only on newspaper reports without getting the response from the concerned authorities.


Earlier, Supreme Court rejected PILs regarding women’s reservation bill and voting rights for Non Resident Indians (NRIs) on the basis that Supreme Court has no right to give directions to Parliament to enact a law. The Court also rejected the PIL on seeking a direction for the government to prevent road accidents.
