November 16, 2021, has been fixed as a hearing date for the plea challenging the Centre and Medical Counselling Committee notice providing 27 per cent reservations for OBC and 10 per cent for the EWS category in the NEET PG 2021 admission.
Hearing requested after Diwali
As per reports, the SC bench of Justices DY Chandrachud, Vikram Nath and BV Nagarathna was told by the Solicitor General Tushar Mehta that the government has conducted a discussion with the senior officials of the department and authorities who have framed the notification. Mehta has requested that the matter on the reopening of the counselling be taken up after Diwali vacation. He has also assured me that the counselling will not start until the decision is made. The Supreme Court bench also stated that the assurance of the Solicitor General has been taken on record and the matter will be discussed on November 16th.
OBC income limit
The Solicitor General further added that the union government has filed a counter-affidavit responding to the queries and questions which have been asked by the court on fixing the Rs. 8 Lakh limit for determining the Economically Weaker Sections.
Arvind Dattar - senior advocate appearing for the NEET aspirants stated that the Centre in its affidavit has majorly relied on Major General (retd) SR Sinho report which is complicated and detailed.
The Ministry of Social Justice and Empowerment affidavit states that the principle for fixing the amount is rational and considers Articles 14, 15 and 16 of the constitution. The affidavit also states that the exercise conducted to determine the creamy layer for OBC reservation will be equally applicable for determining the EWS category since the fundamental premise is that a person has desired economic standing and may not require the benefits of reservations at the cost of others.
