The Allahabad High Court, according to media reports, will be deciding on a plea filed for seeking a 50 percent reduction in the state school tuition fee until the schools reopen in the state on January 18, 2021. Chief Justice Govind Mathur and Justice Saurabh Shyam Shamshery part of the division bench has directed the standing counsel to contact the state government regarding the matter under Uttar Pradesh Self-Financed Independent Schools (Fee Regulation) Act 2018.
The plea filed for the reduction in the school tuition fee was filed by the High Court BAR Association, District BAR Association, UP Vyapari Mandal, and other private parties.
Schools asking for tuition Fee
The petitioners asserted that the schools are taking tuition fees in the name of online education which is against the rules further adding that conducting the online classes is much cheaper than conducting the physical classes in the schools and in the interest of all, the fees for SitAt-Home Education can by no means be equated with or be considered same as the physical education of the pre-COVID-19 era.
The petitioners have further requested for a waiver in the fee charged for the additional activities including the extra-curricular, sports, library, and other fasciitis not being utilized during the online education. A fee waiver has been requested for fee waivers for CBSE and ICSE regulated schools while calling for a uniform fee structure through the schools until the online classes are being conducted.
The Allahabad High Court in June had dismissed a Public Interest Litigation asking for a complete waiver of school fees which include tuition fees by private schools amidst the pandemic. Many of the state governments have also requested relief in school fees including Delhi which had accepted the plea and ordered to only charge the tuition fee.
Schools have been shut across the country since March 2020 due to the COVID-19 pandemic following which the parents have been asking the school management to consider a fee waiver owing to the financial crisis faced by the students. Many of the state governments have however provided waivers for the students taking the school managements to reduce the school fee or provide longer time periods to submit the school fee.
