UP Special TET 2026:- The Allahabad High Court has delivered a major legal verdict regarding the scope of the upcoming UP Special Teacher Eligibility Test (Special TET 2026). Dismissing a batch of petitions filed by 221 Shiksha Mitras, a single-judge bench comprising Justice Manju Rani Chauhan ruled that Shiksha Mitras cannot claim eligibility for UP Special TET merely because they fulfill the conditions for the general open UPTET. The High Court has clarified that the Special TET 2026 is not a new recruitment or selection process, but a narrow legal window created specifically for serving, regular government teachers whose continuation in service depends on clearing TET under binding directives from the Supreme Court of India.

Why Has the High Court Rejected the Shiksha Mitra’s Petition?

In its detailed judgment, the High Court outlined the distinct legal and constitutional grounds for distinguishing contractual Shiksha Mitras from the regular serving teachers:-

  • The Supreme Court of India has mandated that all existing in-service teachers who are working in government primary or upper primary schools must qualify TET within a strict one-year period to retain their regular posts. 
  • The state issued government orders on September 2, 2026, instructing the UPESSC to conduct the Special TET solely to prevent such serving regular teachers from facing service termination.
  • The court has also observed that the legal status of the ad-hoc or contractual Shiksha Mitras differs fundamentally from that of regular serving teachers. The Constitution does not require the state to eliminate reasonable legal classifications created for valid administrative goals. 
  • The bench also held that eligibility for the standard competitive UPTET does not automatically entitle an individual to claim an entry into a special, in-service compliance exam which has been tailored for regular staff.

What’s Next For Candidates?

For candidates to understand the implications of the High Court ruling, the candidates should understand the difference between UPTET and Super TET. With the Allahabad High Court dismissing all the legal challenges against the notification, the Uttar Pradesh Education Service Selection Commission (UPESSC) will proceed according to its original schedule, with the online application submission closing today, October 4, 2026, and the written exam to be conducted on November 3, 2026.
