High Court Ordered Delhi University to appoint an OBC applicant as Assistant Professor

The High Court of Delhi on 8 October 2012 ordered University of Delhi for appointing a woman applicant, who belongs to the other backward caste (OBC) from Assam at the post of Assistant Professor in Botany Department of the college. The appointment is to be into effect from 13 December 2012.

The petitioner Mahaswetta Saikia filed a petition in the court after the University denied to offer her the letter of appointment by citing confusion on her caste status. She was selected for the post in the OBC category against the vacancy advertised by the University in 2010.

The bench of the court led by Justice Suresh Kait in its decision asked the University to issue the letter of appointment to the petitioner for the post of Assistant Professor in the Botany Department. The court also asked the University to fix her seniority from the day of her being called for receiving the letter of appointment on 13 December 2012.
