Supreme Court Termed Marriages Dissolved by Panchayats Illegal

Supreme Court on 25 August 2010 ruled that a divorce granted by the Panchayat according to the local customs of a particular community would not be recognised by any court of law.

Supreme Court on 25 August 2010 ruled that a divorce granted by the Panchayat according to the local customs of a particular community would not be recognised by any court of law. A  Supreme Court division bench of justices P Sathasivam and BS Chauhan ruled that a divorce mandatorily needs a judicial decree from a court of law, in order to be legalised. The bench noted that dissolution of marriage through Panchayat according to the customs prevalent of that area or community cannot be the basis for divorce under section 13 of The Hindu Marriage Act, 1955.


Supreme Court gave its judgment in the case of the marriage of Mahendra Nath Yadav and his estranged wife Sheela Devi whose marriage was dissolved by the Panchayat.
