SC dismisses Board Exam 2022 Cancellation Plea: In a major blow to lakhs of students, the Supreme Court of India has dismissed the plea seeking cancellation of Board Exams 2022. During the hearing which was lined up at 2 PM in the afternoon, 3-judge bench headed by Justice AM Khanwilkar dismissed the plea calling it ‘ill-advised, premature.’ The bench noted that as of now the Boards are yet to take a final decision with regards to holding the board exams and therefore it would not be right for the court to intervene at this moment. In future, “if decisions is not in accordance with rules & Act it will be open to aggrieved persons to set a challenge in that regard” said the Bench while dismissing the petition.

    NIOS – National Institute of Open Schooling has filed a reply to the petition before the Supreme Court. In its response, NIOS has noted that all arrangements have been made to conduct exams in April in compliance with COVID protocols.

    93 percent Students Seek Online Exams or Internal Assessment

    Ahead of the big hearing in the Supreme Court over the cancellation of Board Exam 2022, Adv Anubha Shrivastava Sahai shared details of a survey done on the matter seeking the opinion of students on the matter. As per the findings of the survey, of the total 2.15 Lakh respondents, only 7% of students have said that they are okay with offline regular board exams; the rest 93% have sought online exams and internal assessment.

    Petition Filed by Anubha Shrivastava Sahai

    The petition challenging the holding of offline board exams for 2022 session has been filed by Advocate Anubha Shrivastava Sahai. Ms Sahai is a lawyer, child rights activist. She also heads the India Wide Parents Association and following sharing of concerns by several groups of parents and students; she has moved the petition before the apex court.

    CBSE Term 1 Results 2022 Expected Soon

    The hearing regarding cancellation of Board Exams 2022, especially for Central Board’s of CBSE, CISCE and NIOS, comes at a time when CBSE Board Class 10 and Class 12 students are awaiting declaration of Term 1 Results. For 2022 session, CBSE Board decided to hold CBSE 10th and 12th Exam 2022 in two terms of which Term 1 Exam was held on Nov – Dec months while Term 2 Exam is scheduled to be held in April. While CBSE Term 1 Exam 2022 has been held, the result for the same has been delayed and is expected to be announced this week.

    Plea filed by Students of 15 Different Boards

    With the Board Exam 2022 dates being announced by several state boards, students of over 15 different states and central boards have gathered together to file the petition before apex court seeking alternative assessment mode. These students are demanding a solution similar to last year, when evaluation of their performance was done on the basis of alternative assessment criteria i.e., internal exams and a formula devised by the board.

    Plea seeks alternative assessment mode instead of offline exams

    As per the petition filed before the apex court, the petitioners have sought directions from the Supreme Court to the board demanding alternative assessment mode for 2022 year. As per their argument, for this year, learning was held in online mode which is an alternative technique adopted due to the pandemic. And in the light of this, it would be wrong to hold regular offline exams, when students have not attended classroom based lectures for a major part of the year.

    3-Judge Bench to hear Plea

    The petition challenging holding of offline exams by CBSE, CISCE and other state boards has been filed by Adv Anubha Shrivastava. She sought urgent hearing of the matter by the Apex Court on Monday, following which the case has been lined-up for today and will be heard by a 3-judge bench headed by Justice AM Khanwilkar, who will be joined by Justice Dinesh. Maheswari and Justice CT Ravikumar.
