Government Abolish No Detention Policy For Class 5th and 8th

In a significant shift in education, officials say the Center has eliminated the "no-detention policy" for classes 5 and 8 in schools under its control, enabling them to fail children who fail the year-end tests.

Following a 2019 change to the Right to Education Act (RTE), at least 16 states and two Union Territories have already eliminated the "no-detention policy" for the two grades.

Failed Students to Retake Exams Within 2 Months

According to an official statement, students who do not pass the yearly tests will receive extra tutoring and be offered the chance to retake the exam within two months of the results. 

Should the child who is taking the re-examination not meet the promotion requirements once more, he will be placed in fifth or eighth grade, depending on the situation. If a child is held back, the class teacher will guide both the child and their parents, if needed, and offer specialised support to address learning gaps identified during different stages of assessment, according to the notification.

No Child Expulsion Rule Remains in Effect

However, the government has made it clear that no child can be expelled from school until their education is finished.

The notification will be applicable to more than 3,000 central government-run institutions, including Sainik institutions, Navaodyala Vidyalayas, and Kendriya Vidyalayas, according to senior Education Ministry officials. 

State Govts to Decide on the Matter

States have the authority to decide on this matter because schooling is a state subject. 16 states and two union territories, including Delhi, have already abolished the no-detention rule for these two classes.

According to a senior official, the remaining states and UTs have chosen to stick with the policy, while Haryana and Puducherry have not yet made a choice.
