NEET PG Counselling: According to the latest media reports, the Supreme Court has allowed the resuming of the NEET PG 2021 Counselling process. The Supreme Court in its verdict given today - January 7, 2022, has upheld the validity of OBC Reservations in NEET UG and PG stating that the OBC quota of 27% and reservation of 10% for EWS will remain intact. Justice DY Chandrachurd stated that the submissions necessitate a detailed interim order on the EWS criteria for NEET PG 2021 and the formulation of reasons for the order will take some time. The special bench of Justice DY Chandrachud and Justice AS Bopanna pronounced the verdict.
The court stated that the recommendations of the Ajay Bhushan Pandey Committee regarding the EWS criteria notified in 2019 should be used for admissions to NEET PG 2021-22 academic session. The Supreme Court also stated that the counselling for the NEET UG and PG courses will be conducted as per the government notification of July 29, 2021, with 27 per cent OBC and 10 per cent EWS Quota reservations in All India Quota Medical admissions.
The SC has further stated that the criteria for determining EWS Category as notified in January 2019 will be used to identify the candidates who have appeared for NEET-UG and PF in the 2021-22 session.
Challenge on Notification
The Supreme Court petition was filed challenging the July 29, 2021 notification of the centre and the Medical Counselling Committee to provide 27 percent reservation to OBC and 10 Percent to EWS candidates under the All India Quota. Arguments on the petition were made by Senior Advocates Arvind Datar, Shyam Divan and P Wilson.
The NEET PG 2021 Counselling was scheduled to commence on October 25, 2021, but was deferred until further notice due to the intervention of the Supreme Court. Recently, the resident doctors were also found protesting against the delay in the counselling procedure stating that the burden of the delay was falling on the residents who are working continuously under such circumstances.
