The Supreme Court has clarified the employment status of candidates serving as primary school teachers with a B.Ed. degree. Emphasizing the pivotal role of qualifications, the apex body clarified the previous stance made in August 2023.
As per the ruling, individuals appointed through advertisements requiring a B.Ed. degree will maintain their positions. This decision was made in response to a petition regarding the employment status of B.Ed. degree holders as primary teachers. Previously, on August 11, 2023, the Supreme Court had declared B.Ed. degree holders ineligible for primary teacher positions, causing significant confusion among candidates and current primary teachers. However, the Supreme Court has now clarified that those recruited before the August 2023 decision will not be affected; their jobs will remain secure. Conversely, those who joined after the ruling will be impacted.

The apex court has further clarified that the jobs of candidates recruited through standard appointments, where a B.Ed. qualification was specified in the job advertisement, will also be secure.

This decree extends to all states. Responding to a clarification request from the Madhya Pradesh Government, the bench consisting of Justice Aniruddha Bose and Justice Sudhanshu Dhulia stressed that the constitutional right to primary education in India extends beyond merely providing free and compulsory education to children under the age of 14; it also mandates the provision of quality education.
