AIBE 19 Exam 2024: The Supreme Court of India has issued an order allowing final year law students to appear for the All India Bar Examination (AIBE) exams. The order has been issued challenging the Bar Council of India’s decision to exclude final year law students from appearing for the exams.
AIBE 19 exams are scheduled for November 24, 2024. The SC bench led by CJI DY Chandrachud, Justice JB Pardiwala and Manoj Misra were hearing the petition challenging the recent notification of the BAR council regarding the eligibility criteria for AIBE 19 exam. The SC bench order states that the BCI shall permit the registration of all students who fall within the paragraph 38 of Bonnie Foi decision. The direction has been given to operate in rem for AIBE scheduled for November 2024.
The petition filed argues that BCI notification prevents them from taking the AIBE 19 exam. The decision contradicts the constitutional bench judgment in Bar Council of India V. Bonnie Foi Law College which stipulates that final year law students should be allowed to appear for AIBE.
As per Paragraph 38 of Bonnie Foi Law College decision, the constitution bench stated that students who have cleared all exams required to pursue the final semester of their law course may be allowed to take the AIBE exam provided that they present proof the results of the exams will however only be valid if the candidate has passed all the components of their course and will remain valid only for a specific period of time.
