NEET, JEE Main 2020 Postponement: Supreme Court has rejected the review petition filed by 6 Opposition Ruled States demanding postponement of JEE Main 2020 and NEET 2020 entrance exams. A 3-judge bench of the apex court rejected the plea saying that there is no merit in the plea. SC bench of Justices Ashok Bhushan, B R Gavai and Krishna Murari rejected the plea filed by Ministers of 6 Opposition Ruled States i.e. Maharashtra, Punjab, Rajasthan, West Bengal, Chhattisgarh and Jharkhand. The petition sought to protect to protect over 25 lakh students from serious health risk given the rising number of infections and deaths due to COVID-19.

 

Plea rejected by 3 Judge Bench

As per the information available right now, a 3 judge bench of the Supreme Court consisting of Justices Ashok Bhushan, B R Gavai and Krishna Murari will consider the review petition in chambers. The review plea has been filed by ministers from West Bengal, (Moloy Ghatak), Jharkhand (Rameshwar Oraon), Rajasthan (Raghu Sharma), Chhattisgarh (Amarjeet Bhagat), Punjab (B S Sidhu) and Maharashtra (Uday Ravindra Sawant). The petition was filed by advocate Sunil Fernandes, which says that the court in its earlier order fails to satisfy the safety and security concerns of students who have to appear for the exam.

SC’s earlier order ‘Cryptic’

The review petition filed by the 7 Ministers of Opposition Ruled states says that the order passed by the Supreme Court in this matter was ‘cryptic and non-speaking’. The petition also claims that the earlier judgement doesn’t discuss various aspects and complexities involved in a matter. The court had primarily given two reasons for rejection of plea seeking postponement i.e. life must go on and students should not lose an academic year. According to the review petition, neither of them constitute and authoritative and comprehensive judicial scrutiny on the issue.
