AIBE eligibility criteria 2023 is specified by the  Bar Council of India (BCI) along with the official notification. AIBE is a mandatory exam which is conducted by the Bar Council of India for law graduates who are willing to practice law in India. Candidates who qualify the exam are awarded the Certificate of Practice (CoP) that allows them to practice law in India.

State Bar Council Registration/Enrollment for AIBE

In 2017, BCI clarified for AIBE X that candidates who have been enrolled with the State Bar Councils are eligible to appear for AIBE.

Thus, it is mandatory for the candidates to be enrolled with the State Bar Council as an Advocate. Those who are not enrolled as an Advocate are not allowed to apply for the AIBE exam 2023.

What is AIBE XVIII (18) Age Limit?

There is no upper or lower age limit specified by AIBE to appear for the AIBE 2023 Exam. 

AIBE Educational Qualification

Candidates who have passed a three year LLB or five year LLB degree can appear for the AIBE 18 exam 2023. Thus, the AIBE academic qualification consists of:

  • 3-year LLB degree, OR
  • 5-year integrated LLB degree

Number of Attempts for AIBE

As per the Bar Council of India, there is no limitation on the number of attempts to appear for AIBE. Thus, candidates have multiple chances to take the AIBE.  However, candidates have to qualify for AIBE within two years of provisional enrollment with the State Bar Council. Hence, according to the BCI, 

  • Candidates can attempt AIBE examination multiple times until qualified. 
  • Candidates can attempt AIBE even after they fail a number of times.

AIBE Eligibility Criteria 2023: Exemptions 

The AIBE exam has become compulsory in India post-2009-10 onwards. BCI has set the eligibility criteria for those candidates who are exempted from taking the exam. Check the exemptions made by BCI for AIBE 18 exam: 

  • Law graduates who have passed their three-year LLB or five-year LLB degree before 2009-2010 do not have to appear for AIBE exam. Such candidates can practice law without CoP. 
  • Those who graduated in 2008 or earlier, and enrolled later (irrespective of year of enrollment), are also exempted from AIBE.

Minimum Marks Requirement in AIBE Exam

According to BCI, there is no minimum marks required to appear in the AIBE exam. However, a candidate must secure a minimum percentage or grades in their law degree as prescribed by universities for further education. 

AIBE Eligibility Criteria to Obtain COP 

Candidates who will be appearing for the AIBE exam 2023, must obtain the minimum qualifying marks set by BCI to get the CoP. The minimum marks requirement for AIBE CoP is as follows: 

  • Candidates who belong to the General/ OBC category must obtain at least 40% marks from the total scores of AIBE exam. 
  • Candidates who are from SC/ST/PWD category must obtain at least 35% marks in AIBE examination. 

AIBE Eligibility Criteria for Disabled/ Physically Challenged Candidates

The AIBE academic eligibility for physically disabled candidates is the same as for other candidates. However, such candidates must ensure that the following criteria are also fulfilled: 

  • A disability certificate must be issued by a medical authority.
  • The disability of the candidates must be more than 50% under specific categories like blindness, amputated arms, or any other physical incapability.
  • This is requirement is applicable in case the candidates want to increase their exam duration by 20 minutes per hour i.e. they will be allowed an extra time of one hour for the AIBE exam duration.
